Delta-8 and Drug Tests: Will You Pass or Fail?

When the Agricultural Improvement Act of 2018, also known as the 2018 Farm Bill, was signed into law, the interest in more cannabis products grew. This is because the bill removed cannabis or hemp and its other low-THC derivatives from the list of Schedule I substances, which are restricted or heavily regulated.

THC or Delta-9 tetrahydrocannabinol is the main chemical compound in marijuana that makes it psychoactive. Cannabis products that contain more than 0.3% THC fall under the marijuana category, making them controlled substances.

On the other hand, cannabidiol or CBD is another chemical compound derived from cannabis. This is primarily extracted from hemp instead of marijuana and has less than 0.3% THC. As such, the farming, sale, and use of CBD became federally legal.

The legalization of cannabis products resulted in a renewed interest in another low-THC derivative of hemp — the Delta-8 tetrahydrocannabinol or simply Delta-8 THC.

What is Delta-8 THC?

Delta-8 THC is a cannabinoid or a naturally occurring psychoactive compound found in cannabis plants. Like Delta-9, it’s a form of THC molecule, albeit THC is less stable than Delta-8, which makes the former more potent and causes more reactions in the human body.

The difference in potency between Delta-9 and Delta-8 means the latter gives a milder high. What’s more, the adverse effects associated with THC, such as paranoia and anxiety, manifest in much milder ways with Delta-8.

Because of this, Delta-8 is also called “diet weed.” It can give you just the right amount of high to relax and feel euphoric without making you frantic and unfocused. This is why many people are turning to Delta-8 if they want to get high without serious consequences.

Hemp, from which CBD is derived, has low concentrations of Delta-8. Because of this, manufacturers of Delta-8 use CBD combined with strong acids to convert CBD and create concentrated amounts of Delta-8.

Delta-8 THC on Drug Tests

If Delta-8 is THC but usually derived from CBD, you might be wondering whether it shows up on drug tests. The short answer is yes, it does.

Taking Delta-8 or Delta-9 leaves metabolites in your body. When you intake THC, your body breaks down the chemicals through the process you know as metabolism.

Metabolites are the products of metabolic reactions within the cells. They stay in the body long after the actual drug has left your system. As such, drug tests detect the presence not just of the parent drug but also the metabolites it produces.

Since Delta-8 and Delta-9 are types of THC with similar chemical structures, if you only take the former, you may test positive for Delta-9, resulting in a false positive and a failed drug test.

This is because most testing kits only detect the presence of THC metabolites, which both Delta-8 and Delta-9 produce. These metabolites can stay in the body for up to 90 days.

You don’t have to panic, though, because common drug test methods usually don’t detect metabolites past the 48-hour mark since you took Delta-8 THC. Some of the most common drug testing methods and their THC detection period are as follows:

Urine Testing

The most common method of drug testing, a urine test can detect THC in your system for up to 3 days if you’ve only tried it once. If you take Delta-8 THC moderately, which is to say every other day, a urine test can detect traces of THC for up to 7 days since your last use.

If you use Delta-8 daily, this test will find THC in your system up to 15 days since you last used any product. And if you use Delta-8 products multiple times a day, your urine sample up to 30 days since your last use can show THC.

Saliva Testing

Saliva testing has one of the shortest windows of THC detection at up to 72 hours, and can only detect the presence of THC in your system if you smoke or ingest your Delta-8 product. This is because the metabolites are only present in the saliva.

Blood Testing

Similar to saliva testing, blood testing tests recent Delta-8 use. Your blood may show THC metabolites 2 to 12 hours after your last use. However, if you are a heavy user, the THC metabolites in your body can be detectable for up to 30 days.

Hair Testing

Cannabinoids reach your hair follicles through the blood vessels in your body. Since the hair grows about half an inch per month on average, it’s like a diary that a hair follicle test can easily read. It can detect THC in your hair for up to 90 days after your use of Delta-8.

What Happens If You Fail a Drug Test Because of Delta-8?

Delta-8 THC is legal for sale and use in most states. However, its use is restricted in California, Minnesota, and Mississippi and outright illegal in more states, including:

  • Alaska
  • Arizona
  • Colorado
  • Delaware
  • Idaho
  • Iowa
  • Montana
  • Nevada
  • New York
  • North Dakota
  • Rhode Island
  • Vermont
  • Utah
  • Washington

Since the sale and consumption of Delta-8 are prohibited in these states, if you fail a drug test, you will face legal repercussions. If you live anywhere where Delta-8 is legal, you may be able to explain that it’s a false positive due to your use of D8.

How to Use Delta-8 Responsibly

Like anything you consume, it’s best to consume Delta-8 in moderation. As a mildly psychoactive substance, irresponsible consumption can put your health and safety at risk. We suggest the following ways to use Delta-8 responsible:

  • Do your research. Delta-8 products come in many forms, from gummies to tinctures. Research and experiment with which works best for your needs.
  • Buy from trustworthy providers. Buying low-quality Delta-8 products or from illegal suppliers can pose risks to your health since you can’t be sure of the quality.
  • Consume in moderation. No matter your reason for taking Delta-8, make sure not to overuse it. Although it doesn’t cause addiction, and there have never been overdose reports, it’s still best to use it only when you need it.
  • Don’t take Delta-8 before a drug test. If you know a drug test is coming up, it’s best to play it safe and refrain from ingesting D8 leading up to the test.
